Warranty & Terms

All Data Translation hardware products and software media are covered by a full one-year warranty. All Data Translation software products are non-returnable and non-refundable. Products repaired or replaced within this warranty period maintain their original warranty. Products repaired or replaced outside the warranty period are warranted for 90 days from invoiced date of return.

A. HARDWARE – Data Translation, for the effective period of the warranty set out below, warrants that the standard hardware products sold hereunder will be free from defects in materials and workmanship under normal use and service. Data Translation’s obligation under this warranty shall not arise until Buyer returns the defective product, freight prepaid, to Data Translation’s facility or another specified location. The only responsibility of Data Translation under this warranty is, at its option, to replace or repair, free of charge, any defective component part of such products.

B. SOFTWARE MEDIA – Data Translation, for the effective period of the warranty set out below, warrants that the physical CD/diskette sold hereunder will be free of defects in materials and workmanship. Data Translation’s obligation under this warranty shall not arise until Buyer returns the defective product, freight prepaid, to Data Translation’s facility or another specified location. In the event of notification within the warranty period, Data Translation will replace the defective CD/diskette, free of charge.

C. EFFECTIVE PERIOD OF WARRANTY – All systems, boards, modules, components and software media one year from date of invoice.

D. REPAIRED OR REPLACEMENT PRODUCT (OUT OF WARRANTY) – Data Translation, for a period of 30 days, warrants that its standard products repaired or replaced hereunder shall be free from defects in workmanship or material under normal use and service. Data Translation’s obligation under this warranty shall not arise until Buyer returns the defective product, freight prepaid, to Data Translation’s service department. The sole responsibility of Data Translation under this warranty is, at its option, to replace or repair, free of charge, any defective component part of such products. Any repair or replacement shall not extend the period within which the warranty can be asserted.

This warranty does not extend to and shall not apply to the following:

1. Products which have been repaired or altered by someone other than Data Translation personnel, unless the Buyer has properly altered or repaired the products in accordance with procedures previously approved in writing by Data Translation.

2. Products which have been subject to misuse, neglect, accident, or improper installation.

THE WARRANTY AND REMEDIES SET FORTH ABOVE ARE IN LIEU OF ALL OTHER WARRANTIES EXPRESSED OR IMPLIED, ORAL OR WRITTEN, EITHER IN FACT OR BY OPERATION OF LAW, STATUTORY OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE WHICH DATA TRANSLATION SPECIFICALLY DISCLAIMS. DATA TRANSLATION, INC. NEITHER ASSUMES NOR AUTHORIZES ANY OTHER PERSON TO ASSUME FOR IT ANY LIABILITY IN CONNECTION WITH THE SALES, INSTALLATION, OR USE OF ITS PRODUCTS. DATA TRANSLATION, INC. SHALL HAVE NO LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND ARISING OUT OF THE SALE, INSTALLATION, OR USE OF ITS PRODUCTS.

Category 3 Products:

Any Data Translation product that does not have a published list price in either the product catalog or corporate web site is classified as a Category 3 product. Orders for Category 3 products are non-returnable/non-refundable. Shipment schedules in conjunction with Category 3 orders will be defined in the customer’s original purchase order. Purchase order changes will not be allowed once the purchase order has been acknowledged and accepted by Data Translation.

Customer Service Policy:

A. Data Translation, Inc. will repair or replace, at its option, any faulty item within ten business days after receipt of said part regardless of its warranty status.

B. A Quick Turnaround Plan is available to expedite servicing. Contact the Data Translation Customer Service Department for details.

C. If product should fail during the warranty period, it will be repaired free of charge. For out-of-warranty repairs, the customer will be invoiced for repair charges.

Return Policy:

To return an unopened hardware product within 30 days of invoice date, contact your Data Translation sales representative. You will receive a full refund, less a restocking fee of 25% of net selling price. This policy only applies to hardware products having a published list price on the Data Translation website. Refunds and returns are not offered on software products or products classified as Category 3.

Repair Procedure:

Upon determining that repair services are required, contact the Data Translation Repair Center Department at (508) 481-3700 ext. 1323 to obtain a Return Material Authorization (RMA) number. Have the following information ready when you call: complete product model number; product serial number; name, address, and telephone number of person returning product; and any special repair instructions (also include a purchase order number if the repair is out of warranty). Carefully package the product in anti-static packaging, making sure the RMA number appears on the outside of the package. Include a description of the malfunction along with the return address and telephone number of a technical contact.

Upon completion of the services required, an invoice is issued stating charges, when applicable, and work completed. A packing slip is enclosed in the return shipment. Data Translation will prepay return shipments via UPS for all continental U.S. returns. For returns requested via air freight, material will be sent Air Collect.
